These Terms of Service ("Terms") govern your use of the Memory Jar mobile application and website (together, the "Service"), operated by Branch Labs ("we," "our," "us"). By creating an account or using the Service, you agree to these Terms.
Subscription purchases made through the App Store are also governed by Apple's Standard End User License Agreement (EULA), which is incorporated into these Terms by reference.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You agree that any information you provide is accurate and that you will keep it up to date.
You are responsible for maintaining the security of your password (or your Sign in with Apple credentials) and for all activity that occurs under your account. Notify us immediately at support@branchlabsapp.com if you believe your account has been compromised.
You retain all rights to the photos, videos, audio recordings, text, and other content you create in the Service ("Your Content"). Your Content stays on your device and in your personal Apple iCloud account; Branch Labs does not store, access, or process Your Content. We do not use Your Content to train AI models or for any purpose. The limited license you grant to Apple to sync and share Your Content via iCloud is governed by Apple's iCloud Terms.
Memory Jar's family-sharing feature uses Apple's CloudKit sharing technology. When you invite a co-parent, grandparent, or other family member, an invitation link is generated by Apple's servers and the shared family data lives in your iCloud zone. You agree:

Memory Jar offers a free tier and an auto-renewable Premium subscription tier with a 14-day free trial. Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You may cancel anytime in iOS Settings → Apple ID → Subscriptions. Refunds are governed by Apple's policies; we do not directly issue refunds for App Store purchases.
If you enable Apple's Family Sharing on your subscription, members of your Apple Family Sharing group can access Memory Jar Premium through their own Apple ID. Memory Jar's in-app family graph (co-parents, grandparents) inherits Premium access automatically when the primary parent has an active subscription, and loses access if the primary cancels.
You may delete your account at any time from within the app (Settings → Account → Delete Account) or by emailing support@branchlabsapp.com. We may suspend or terminate your account if you violate these Terms or use the Service in a way that risks harm to others or to the Service.
The Service is provided "as is" without warranties of any kind. We do our best to keep the Service running reliably, but we do not guarantee uninterrupted availability. Because Your Content lives in your personal iCloud, we recommend you also keep your own backups of irreplaceable memories — for example, by saving photos to your Photos library or exporting via the in-app data export feature.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim, or $50 if you have not made any payments.
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the United States and the state in which Branch Labs operates, without regard to conflict of laws principles.
